			<content:encoded><![CDATA[<p style="margin-top: 0px">The metamorphosis from paper to celluloid is never smooth, and the film &quot;Breakfast at <a href="http://www.sterlingtiffany.com/" target="_blank"><b>Tiffany</b></a>&#8216;s&quot; (1961) presented Paramount studios with an array of difficulties. Sam Wasson&#8217;s account of the making of the movie covers them all. En route, &quot;Fifth Avenue, 5 A.M.&quot;&#8211;as appropriately slender as the 1958 Truman Capote novella from which the film was made&#8211;offers lots of savory tidbits. Capote, for example, wanted Marilyn Monroe to play the lead character, Holly Golightly. Monroe&#8217;s acting coach, Paula Strasberg, refused to let America&#8217;s reigning sex symbol impersonate &quot;a lady of the evening,&quot; and the part went to Audrey Hepburn, who didn&#8217;t really want it.</p>
<p style="margin-top: 0px">&quot;To think,&quot; Mr. Wasson begins, that the movie &quot;almost didn&#8217;t come off . . . that the censors were railing against the script, that the studio wanted to cut &#8216;Moon River,&#8217; that [director] Blake Edwards didn&#8217;t know how to end it.&quot; That Capote&#8217;s work &quot;was considered unadaptable,&quot; Mr. Wasson writes, &quot;seems almost funny today.&quot;</p>
<p style="margin-top: 0px">No, it doesn&#8217;t. The novella was unadaptable. Although the movie is fondly remembered by those who were very young in 1961, Capote&#8217;s acute character studies of a blithe, air-headed &quot;socialite&quot; who escorted wealthy men around Manhattan after dark, and of her colorful in-group, were hammered into a cinematic gallery of grotesques.</p>
<p style="margin-top: 0px">Caparisoned in smashing Givenchy ensembles and wielding a cigarette holder the size of a javelin, Audrey Hepburn did some elegant posing in lieu of acting; George Peppard was rigid and humorless as a romantic leading man&#8211;a hint of what was to come when he starred in the TV series &quot;The A-Team.&quot; To bottom it all off, Mickey Rooney, badly miscast as Mr. Yunioshi, Holly&#8217;s Japanese neighbor, delivered a racist caricature.</p>
<p style="margin-top: 0px">There were a few alleviating moments&#8211;Buddy Ebsen as the yokel whom Holly Golightly married when she was 14; Patricia Neal as the woman who regards Peppard&#8217;s character as her boy-toy. Alas, they couldn&#8217;t hide an absence of plot, theme or wit. But because Capote is one of the central literary and social figures of 20th-century New York,<a href="http://www.sterlingtiffany.com/product-1.html" target="_blank"><b>Tiffany key rings</b></a>, because Audrey Hepburn became the most memorable Hollywood gamine since Lillian Gish,<a href="http://www.sterlingtiffany.com/product-4.html" target="_blank"><b>Tiffany bangles</b></a>, and because Blake Edwards went on to direct the Inspector Clouseau comedies, &quot;Fifth Avenue, 5 A.M.&quot; (the title refers to the moment when Hepburn was filmed arriving at Tiffany&#8217;s in a cab) is as compelling as it is trivial.</p>
<p style="margin-top: 0px">A producer tries to convince Audrey that she&#8217;d be an ideal Holly. &quot;You have a wonderful script,&quot; the star demurs, &quot;but I can&#8217;t play a hooker.&quot; He purrs: &quot;We don&#8217;t want to make a movie about a hooker. We want to make a movie about a dreamer of dreams.&quot; And she buys the line. In an effort to sanitize Paramount&#8217;s portrait of a demimondaine, the studio publicity department churned out reams of flapdoodle, defining Holly as a &quot;kook&quot; rather than a B-girl. After all, as one of the publicists observes, &quot;the star is Audrey Hepburn, not Tawdry Hepburn.&quot;</p>
<p style="margin-top: 0px">A talent rep at Creative Management Associates pushes Mickey Rooney for the part of Mr. Yunioshi. A few years later, the rep finds himself meeting with another client, the director Akira Kurosawa. Chill time. &quot;When he realized that I had been involved with the decision to cast Mickey Rooney as a Japanese man, he almost couldn&#8217;t talk to me. I felt awful. I was so embarrassed.&quot;</p>
<p style="margin-top: 0px">Letty Cottin Pogrebin, a co-founder of Ms. Magazine, thanks &quot;Breakfast at Tiffany&#8217;s&quot; for her feminist liberation. To her, as to many other co-eds of the time, the movie represented the dawn of the modern woman. In their eyes, as she recounts to Mr. Wasson, Holly Golightly &quot;was a single girl living a life of her own, and she could have an active sex life that wasn&#8217;t morally questionable. I had never seen that before.&quot; Inspired to adopt some of Holly&#8217;s &quot;kookiness&quot; for herself, Letty went out and bought a scooter, a dog, a rabbit and a duck.</p>
<p style="margin-top: 0px">The reviews were mixed, but Capote did not waver in his appraisal. The book,<a href="http://www.sterlingtiffany.com/product-6.html" target="_blank"><b>Tiffany cuff links</b></a>, he said, was &quot;rather bitter&quot; and &quot;real,&quot; but the film was &quot;a mawkish valentine to New York City and Holly and, as a result, was thin and pretty,<a href="http://www.sterlingtiffany.com/product-17.html" target="_blank"><b>Tiffany pendants</b></a>, whereas it should have been rich and ugly. It bore as much resemblance to my work as the Rockettes do to [the Russian ballerina Galina] Ulanova.&quot;</p>
<p style="margin-top: 0px">Mr. Wasson brings a lively and impudent approach to his subject&#8211;he offers sub-headings like &quot;Mr. Audrey Hepburn&quot; (referring to Mel Ferrer, Hepburn&#8217;s unhappy husband) and &quot;What Truman Capote Does in Bed&quot; (he writes). Most of the anecdotes have a ring of authenticity, justifying the price of admission. Still, those of us old enough to have consumed the under-nourishing film the first time around should have the right to demand a senior discount.</p>

<p style="margin-top: 0px">The race, modeled after a wildly popular event in Raleigh,<a href="http://www.sterlingtiffany.com/" target="_blank"><b>tiffany</b></a>, requires runners to trek 1.8 miles to a midway point where they will find &quot;tables of donuts.&quot;</p>

<p style="margin-top: 0px">Those who take on the challenger category and successfully down all 12 donuts &#8212; and the 2,400 calories that come with them &#8212; and make it to the finish line within an hour will receive a special T-shirt.</p>

			<content:encoded><![CDATA[<p>The technology that has given us cell phones, texting,<a href="http://www.sterlingtiffany.com/product-21.html" target="_blank"><b>Tiffany Sets</b></a>, Facebook, Google, et al., has almost phased out one of our most satisfying and popular pastimes &#8212; good old-fashioned gossiping.</p>
<p style="margin-top: 0px">Being able to spread the news instantly to hundreds of eager ears that John Romeo was spotted kissing Joe Dullard&#8217;s wife, Lolita, takes all the suspense out of passing along such a juicy tidbit through tried-and-true channels. Back in the day,<a href="http://www.sterlingtiffany.com/product-9.html" target="_blank"><b>Tiffany rings</b></a>, if you wanted to get or give the lowdown on what was going on, you went to the beauty shop or out to eat.</p>
<p style="margin-top: 0px">Despite all the instant-scoop improvements, there&#8217;s still a lot to be picked up, dished and relished through the old reliable sources. Cock an ear and you can still pick up more telltale conversations than a talking National Enquirer. Like a floating Oprah/Maury/Geraldo show, you&#8217;ll hear about affairs, operations and, best of all, family secrets.</p>
<p style="margin-top: 0px">The beauty shop/salon, or whatever fancy name it might go by, is almost legendary as a place to unload problems. Catholics who haven&#8217;t been to confession since their First Communion use their hairdresser as a confidant, opening up about things they wouldn&#8217;t dream of telling a $150-an-hour shrink.</p>
<p style="margin-top: 0px">That famous line about &quot;only her hairdresser knows for sure&quot; isn&#8217;t strictly about dye jobs. If you&#8217;re lucky enough to be seated at the next station, you can usually pick up some good stuff. In this situation, the conversation is pretty one-sided. The customer talks, the operator listens &#8212; a skill undoubtedly taught at beauty school right along with moussing and bikini waxing.</p>
<p style="margin-top: 0px">Customer: &quot;I just knew he wasn&#8217;t going to any dominos convention, so I checked up on him.&quot;</p>
<p style="margin-top: 0px">BO: &quot;Really.&quot;</p>
<p style="margin-top: 0px">Customer: &quot;That looks much better. &#8230; So I just told him and that floozy &#8230;&quot;</p>
<p style="margin-top: 0px">Drat! My operator turned the blow dryer on me, and I missed the rest of that one. When the noise subsided a different customer had slipped in next door, clucking away about somebody named Hazel&#8217;s new and improved look.</p>
<p style="margin-top: 0px">&quot;The rumor is she&#8217;s had plastic surgery &#8230; part it on the left, please &#8230; why Hazel used to have bags under her eyes so big you could have filled them with sand and saved the levee.&quot;</p>

As the 80 players who have reported to camp took the field for their first practice on Friday afternoon, a white bike remained in front of the players&#8217; dorm.</p>
<p style="margin-top: 0px">It was adorned with the number 4, a reminder that Brett Favre, the Hamlet of Hattiesburg, has placed his comfort over the needs and wants of a team offering to pay him $13 million for six months of employment,<a href="http://www.sterlingtiffany.com/product-5.html" target="_blank"><b>Tiffany bracelets</b></a>, has again placed himself on a different plane than his teammates.</p>
<p style="margin-top: 0px">Favre&#8217;s bike is like Jim Thome&#8217;s favorite glove or Glen Taylor&#8217;s trophy case: It will never be used.</p>
<p style="margin-top: 0px">Vikings coach Brad Childress has displayed wisdom and patience in his courting of Favre. He was right to recruit Favre last summer, and he is right to accede to Favre&#8217;s wishes this summer. For all of his old-school philosophies about teamwork,<a href="http://www.sterlingtiffany.com/product-8.html" target="_blank"><b>Tiffany necklaces</b></a>, cohesiveness, work ethic and responsibility,<a href="http://www.sterlingtiffany.com/" target="_blank"><b>tiffany</b></a>, Childress recognizes that he operates in a results business and that Favre produces far better results than any other quarterback available to him.</p>
<p style="margin-top: 0px">Childress is right to wait for Favre. Favre is wrong to keep Childress waiting.</p>
<p style="margin-top: 0px">Favre&#8217;s teammates and Vikings management seem content with his insistence on extending his summer vacation, but Favre is being illogical, irresponsible and lazy.</p>
<p style="margin-top: 0px">None of his excuses for skipping training camp makes sense, even if you can imagine them being delivered in a charming Southern drawl.</p>
<p style="margin-top: 0px">He wants more time at home? He&#8217;s been in Hattiesburg since January, he&#8217;ll be back by February, and if and when he does retire, he&#8217;ll be there for the rest of his life, and there isn&#8217;t much to do in central Mississippi, anyway, other than sweat and wish you lived someplace else.</p>
<p style="margin-top: 0px">He can&#8217;t stand training camp? This is not an old-school camp, where coaches try to break down players for the purposes of developing toughness and encouraging male bonding. There are badminton tournaments with more hitting than these practices, and the team has moved into a cushy new dorm with air conditioning, and camp lasts two weeks instead of a month.</p>
<p style="margin-top: 0px">He doesn&#8217;t like practice? Vikings players should be insulted that Favre would rather throw to high school receivers in 100-degree heat than throw to them in 80-degree comfort.</p>
<p style="margin-top: 0px">He wants to conserve his arm and energy? Favre would have just as much control over his workload in Mankato as he does at Oak Grove High.</p>
<p style="margin-top: 0px">He doesn&#8217;t need much work to get ready? That proved true last season, when the Vikings began with games against two of the worst teams in existence, the Cleveland Browns and Detroit Lions.</p>
<p style="margin-top: 0px">This year, the Vikings begin with a game that is as ominous as it is symbolic &#8212; an opener in New Orleans. Favre will not be able to pitch-and-putt his way to an easy victory while he reacclimates to the realities of the NFL.</p>
<p style="margin-top: 0px">The team that practiced in Mankato on Friday is as talented and deep as any in the NFL. If you want to find reason for concern in this camp other than Sidney Rice&#8217;s hip or Cedric Griffin&#8217;s knee, you need only look at the Vikings&#8217; two most renowned players, Favre and Adrian Peterson.</p>
<p style="margin-top: 0px">No one with the team would want to hear this term, but Favre is conducting a holdout. He is under contract and sure to play, so his absence should be called nothing less.</p>
<p style="margin-top: 0px">Including playoff games, Peterson fumbled nine times and botched one handoff last season. In his three seasons, his yards-per-rush average has dropped from 5.6 to 4.8 to 4.4.</p>
<p style="margin-top: 0px">He spent four days this offseason at Winter Park, missing most team activities.</p>
<p style="margin-top: 0px">Favre and Peterson avoided working with their team this summer,<a href="http://www.sterlingtiffany.com/product-4.html" target="_blank"><b>Tiffany bangles</b></a>, shirked tasks that would be expected of teammates. Their absences might not damage the Vikings, but any interception Favre throws in New Orleans and any fumble Peterson leaves on the ground in Green Bay will stand as proof that they spent this summer tempting fate and avoiding duty.</p>

			<content:encoded><![CDATA[<p>Lisa Michelle Hall will soon go to prison for preparing false invoices in 2004 and 2005 so that her employer could overcharge the U.S. government for work on Army helicopters.</p>
<p style="margin-top: 0px">Yet even the government prosecutor and investigators handling the case believe that Hall, 34, was simply doing what she was told to do by her boss at the time &#8212; a man who is now her stepfather, Tim Woodard, former president and co-owner of Texas Aviation Services of Fort Worth.</p>
<p style="margin-top: 0px">U.S. District Judge John McBryde called the circumstances &quot;the most puzzling I&#8217;ve ever seen.&quot;</p>
<p style="margin-top: 0px">But July 16, McBryde sentenced Hall, the mother of three children, to 27 months in federal prison for preparing and submitting the inflated invoices. The government contends that Texas Aviation fraudulently billed the Army for more than $256,000 in work that wasn&#8217;t performed.</p>
<p style="margin-top: 0px">The government filed charges of making a false claim against Hall in April, following an investigation that began in late 2007, after Tim Woodard and his father, Carl &quot;Woody&quot; Woodard, had sold the company.</p>
<p style="margin-top: 0px">At her sentencing hearing, Hall testified that she was following Tim Woodard&#8217;s orders when she prepared the invoices. Hall said she would take the records of hours worked on the Army helicopters to Woodard.</p>
<p style="margin-top: 0px">&quot;He would tell me, &#8216;That&#8217;s not enough,<a href="http://www.discountiffany.com/tiffany-rings-c-6.html" target="_blank"><b>tiffany rings</b></a>,&#8217; and tell me how much to bill,&quot; Hall said. &quot;I just did exactly what he told me. He gave me a specific number.&quot;</p>
<p style="margin-top: 0px">Even Hall&#8217;s mother, Olga Woodard,<a href="http://www.discountiffany.com/tiffany-bangles-c-1.html" target="_blank"><b>tiffany bangles</b></a>, who was marketing director of Texas Aviation and married Tim Woodard in December 2007,<a href="http://www.discountiffany.com/tiffany-pendants-c-3.html" target="_blank"><b>tiffany pendants</b></a>, testified that her daughter &quot;was given direction by the owners of the company&quot; when the bills were presented.</p>
<p style="margin-top: 0px">Olga Woodard did not say who specifically gave the orders.</p>
<p style="margin-top: 0px">Why did the company overbill the government? McBryde asked.</p>
<p style="margin-top: 0px">&quot;Mistakes were made,&quot; Olga Woodard said. &quot;It was not intentional.&quot;</p>
<p style="margin-top: 0px">But in her testimony,<a href="http://www.discountiffany.com/tiffany-bracelets-c-2.html" target="_blank"><b>tiffany bracelets</b></a>, Hall was very clear that she did exactly as she was told. A former employee of Texas Aviation and a lawyer for the company both testified that Hall, despite at one point having the title of controller, did not have a significant role in the company&#8217;s management.</p>
<p style="margin-top: 0px">That interpretation of Hall&#8217;s actions was supported by an Army fraud investigator.</p>
<p style="margin-top: 0px">In court, Hall said she carefully documented the changes in the bills she was told to make and stapled all of the supporting documents with copies of the invoices that were placed in the company&#8217;s files.</p>
<p style="margin-top: 0px">Assistant U.S. Attorney John Bradford said there was no evidence that Hall personally benefited from overbilling the government. But Bradford also said the investigation turned up no documents to support Hall&#8217;s claims that she was ordered to submit the false charges.</p>
<p style="margin-top: 0px">McBryde asked Bradford if the government believed Hall&#8217;s testimony that she was directed to inflate the bills by Tim Woodard, and why it wasn&#8217;t prosecuting someone else.</p>
<p style="margin-top: 0px">Bradford said he did believe Hall&#8217;s explanation but that an extensive search of the company&#8217;s files turned up no supporting evidence that would support criminal charges against Woodard or anyone else.</p>
<p style="margin-top: 0px">&quot;My belief is one thing, and what I can prove to a jury beyond a reasonable doubt is another thing,&quot; Bradford said. The records could have been mistakenly thrown out in a general housekeeping, Bradford said, or someone could have made sure they were destroyed.</p>
<p style="margin-top: 0px">A puzzling situation</p>
<p style="margin-top: 0px">Before sentencing Hall, McBryde said the &quot;situation with the family is the most puzzling I&#8217;ve ever seen. The mother is up here pleading for all kinds of mercy, yet she&#8217;s still married to the stepfather who has not done anything to help her [Hall].&quot;</p>
<p style="margin-top: 0px">Contacted by the Star-Telegram, Olga Woodard seemed distraught about her daughter&#8217;s predicament. She said &quot;there&#8217;s more to it&quot; than came out in court, but declined further comment.</p>
<p style="margin-top: 0px">She also said her husband, Tim, was &quot;not available&quot; to comment on the allegations made by Hall.</p>
<p style="margin-top: 0px">Texas Aviation was founded by &quot;Woody&quot; Woodard in 1981. It had a good track record installing customized instruments and interiors in new commercial helicopters and overhauling older aircraft.</p>
<p style="margin-top: 0px">But the company had not performed government work before being hired as one of several subcontractors on the Army program. Texas Aviation was given a contract to remove old electrical wiring and install new wiring and electronics on a batch of well-worn Army National Guard UH-60 Black Hawk helicopters.</p>
<p style="margin-top: 0px">From October 2004 to December 2005, the government alleged, Texas Aviation repeatedly submitted inflated invoices to prime contractors. The amounts billed by Texas Aviation were then marked up by permissible amounts by the prime contractors and included in the bills they submitted to the government for payment.</p>
<p style="margin-top: 0px">In June 2007, the Woodards sold the company to Ranger Aerospace, a privately held investment group. Tim Woodard initially stayed on as president but was later removed, according to the new owners. Olga Woodard had a contract that until recently kept her on the company&#8217;s payroll.</p>
<p style="margin-top: 0px">Bradford declined to comment when asked if the case was still being investigated with an eye toward additional prosecutions. A spokeswoman for U.S. Attorney James Jack said the office would not comment. Bob Cox, 817-390-7723</p>

<p style="margin-top: 0px">Police Chief Scott Cunningham said yesterday afternoon that his internal committee now looking at the case requested the additional DNA testing on clothing worn by Jill Marker,<a href="http://www.discountiffany.com/tiffany-key-rings-c-9.html" target="_blank"><b>tiffany key rings</b></a>, the manager at the store who was severely beaten in December 1995.</p>
<p style="margin-top: 0px">Test results from the SBI earlier this month showed that blood on Marker&#8217;s shirt, as well as on a piece of cardboard, yielded only DNA links to her. There was no link from the evidence to Kalvin Michael Smith, the man convicted of assaulting her, or to anyone else. That includes Kenneth Lamoureux, an early suspect in the case.</p>
<p style="margin-top: 0px">The evidence was sent for testing to the SBI laboratory in March after the internal review showed that those materials had never been tested for the presence of DNA.</p>
<p style="margin-top: 0px">Detectives with the Criminal Investigation Division met yesterday morning with a scientist at LabCorp in Research Triangle Park to discuss the possibility of submitting the clothing to &quot;touch&quot; DNA analysis, a sophisticated test that may be able to retrieve and identify DNA samples from anyone who touched the clothing, Cunningham said in a statement.</p>
<p style="margin-top: 0px">As a result of that meeting, LabCorp will conduct extensive DNA testing with the goal of obtaining identifiable forensic information.</p>
<p style="margin-top: 0px">Results of the testing will be announced as soon as they are available, Cunningham said.</p>
<p style="margin-top: 0px">&quot;While we have complete confidence in the SBI, we are looking to see if other tests might reveal any physical evidence,&quot; Cunningham said.</p>
<p style="margin-top: 0px">&quot;Touch&quot; DNA analysis could be important in the case because of a statement made by a witness who linked Smith to the crime.</p>
<p style="margin-top: 0px">The witness, Eugene Littlejohn, testified at Smith&#8217;s 1997 trial that he accompanied Smith to the store and that Smith at one point grabbed Marker by the arms. More recently, Littlejohn was one of several witnesses who gave affidavits to Smith&#8217;s attorneys recanting their statements, saying they were coerced by the police.</p>
<p style="margin-top: 0px">Jim Coleman, a faculty adviser to the Innocence Project at Duke University,<a href="http://www.sterlingtiffany.com" target="_blank"><b>tiffany</b></a>, which has worked on Smith&#8217;s behalf since 2003, has said &quot;touch&quot; DNA analysis is important because it could yield forensic evidence that would identify another person.</p>
<p style="margin-top: 0px">The police never found any physical evidence linking Smith to the crime. On the night he was arrested, he gave police a statement in which he said he was at the scene, but wasn&#8217;t the attacker. Prosecutors ended up not using that statement, which Smith had recanted, during the trial.</p>
<p style="margin-top: 0px">Earlier yesterday, David Pishko, Smith&#8217;s Winston-Salem-based attorney, had said he would formally request that the city use a private laboratory.</p>
<p style="margin-top: 0px">&quot;They&#8217;ve expressed in the past a willingness to send it to a private lab for testing in the hopes that more sophisticated testing would reveal, or might uncover, more evidence,&quot; Pishko said. &quot;There are no real rules here as to who has to do what.&quot;</p>
<p style="margin-top: 0px">He said the Innocence Project at Duke University, which has worked with Smith since 2003, has offered to pick up the costs associated with testing at a private lab.</p>
<p style="margin-top: 0px">Smith is serving 23 to 29 years in prison. He is appealing his conviction in the federal courts after state courts have turned down his efforts to win a new trial.</p>
<p style="margin-top: 0px">The case has come under intense scrutiny over the past few years from the Innocence Project. In addition, a five-part series in the Winston-Salem Journal in 2004 raised many questions about the case, as did the Silk Plant Forest Citizens Review Committee, which re-examined the police investigation in 2008 and 2009.</p>
<p style="margin-top: 0px">The committee&#8217;s final report, released in August 2009, concluded that the committee didn&#8217;t have much faith in the police department&#8217;s work on the case. Separately, the committee voted 7-2 in favor of a statement that said it found no credible evidence that Smith was at the scene of the crime.</p>
<p style="margin-top: 0px">The internal review is looking at whether to reopen the police investigation. Cunningham said at the news conference that the police will release a full report on the internal review late this summer.</p>
<p style="margin-top: 0px">A key issue in the case has been why former police detective Don Williams,<a href="http://www.discountiffany.com/tiffany-bangles-c-1.html" target="_blank"><b>tiffany bangles</b></a>, the lead investigator in the case, dropped the original suspect, Lamoureux.</p>
<p style="margin-top: 0px">Several witnesses identified Lamoureux as having been in the store on Dec. 9, 1995, the night of the attack.</p>
<p style="margin-top: 0px">Lamoureux knew Marker because she used to work at Today&#8217;s Child, a day-care center where he took his children. He was dropped as a suspect in April 1996 when he moved to Charlotte.</p>
<p style="margin-top: 0px">An affidavit recently filed on behalf of Smith in connection with his federal appeal said that Marker telephoned a friend &quot;upset and anxious&quot; after Lamoureux came into the store the night she was attacked, asked her out and stormed away angrily when she refused.</p>
<p style="margin-top: 0px">Marker made the call to Jeana Schopfer about 8:45 p.m. on Dec. 9, 1995, just minutes before she was attacked.</p>
<p style="margin-top: 0px">Schopfer, who had supervised Marker at Today&#8217;s Child and was a friend,<a href="http://www.discountiffany.com/tiffany-money-clips-c-7.html" target="_blank"><b>tiffany money clips</b></a>, was part of his attorneys&#8217; response to a state motion to dismiss Smith&#8217;s federal appeal.</p>
